Tom and Teri Stark live just a few hundred yards from the entrance to Oregon Resources’ Seven Devils chromite strip mine. ORC is operating 24/7 with trucks entering and exiting the mine every few minutes. While some of these drivers are considerate of the Stark’s and reduce their speed to eliminate the noise impacts of their big trucks, all too many of the drivers appear to take a different approach actually throttling up near the residence.
This family have lived in their home for many years and common decency would dictate that ORC be considerate of their neighbors. The video above is a brief demonstration of what life living next door to ORC has become for the Starks. All emails and phone calls to ORC to discuss the problem have gone unanswered.
I can’t believe the self serving, obviously employee/employer generated letters to The World regarding ORC. I will bet money ORC has it’s employees writing these letters. Probably for a bonus.

Ever notice how many trucks there are everywhere? Not just Coos Bay but all over this country. Especially in areas of higher economic prosperity than Coos Bay. You may not like them for various absurd reasons, but that is no excuse for ignorance. There are no stip mines here. Its called open-pit I believe. There is a huge difference, google it. And this is a business, just like we need here. You can’t expect them to not abide by the laws and regulations for such a corporation. As upset as you are, we still have laws in this country.
Oh and remember Terry v. Ohio. Thats a good read for the starks in particular.

I find it quite sad that “Come.on.now.lady” is quite defensive on ORC’s behalf. It’s as if we have personally attacked him. It’s as if he might be one of the ORC key management people attempting to sway the readers with this ridiculous mean-spirited diatribe. But that is pure speculation on my part.
It makes no difference who I am – just know that I am an intelligent person who is open to thoughtful discourse, which so far I have not seen from you. And if a magnifying glass is placed upon ORC, then you are partially responsible by posting such amusing yet vapid comments that may leave ORC investors wondering what they have been funding this whole time.

All you need to do is watch the video to see differently, supplementing information after the fact adds no quantifyable value as it CANNOT be verified via factual evidence.
I hear no “dawn chorus” in the video but I do see shadows arching in the wrong direction. Can’t convince me there. I asked when this was taken, and you say the 9th? How would you know that Mrs. Stark? Oops did I just figure that one out?
The photographer was obviously in the street at one point. IF, as the video suggests, she had to run flee or “jump back” then she was obviously in the street, and it only confirms videographic evidence to that degree. Again, be careful- I’ll remind you of the implications of Terry v. Ohio.
Oh and what law requires the water truck to even exist? Consider it a nicety by ORC for your local area. Do logging companies do the same? Nope. Say thank you Mrs. Stark.

I cannot help but notice that you seem obsessed with arguing a point of whether or not the video was taken at 5:54 a.m. or in the afternoon. Does the exact time of day REALLY matter? The trucks are, for the most part, running 24/7 and the disruptive noise is there day and night.
The video clip was taken on July 9th, 2011 at 5:54 a.m. If you do your research, as this observer just did, you can go to timeanddate.com to search sunrise times. On July 9th, the sunrise occurred at 5:38 a.m. in Eugene, Oregon – 16 minutes before the videotaping.
This observer notices the dawn chorus which accompanies the penetrating belly dumper noise (you can look up the definition of dawn chorus on several online dictionaries) in the video. Essentially, it is the singing of large numbers of birds at dawn. I know that in my environment, there is not a symphony of birds in the afternoon. Birds sing in large numbers at dawn when the air is cooler and their sounds travel further. It is a way of males guarding their territories and females responding in favorable way.
With that said, onto the next problem you have expressed. The water truck driver. As I said earlier, the neighbor videotaped the event from her own driveway, not on the paved road. The camera has a function that perhaps you may or may not be familiar with. Its called ZOOM. So rather than needing to go up close to the truck itself, the person simply has to press the Zoom function. Therefore the truck was not obstructed in the least, but certainly tried to come close to the person in the driveway.
Also there is more footage of the truck operating in a normal manner. No sudden acceleration – just a easy pace in order to get the job accomplished. Oh, and the water truck does not always manage to clean gravel trackout on the road. If there is gravel at the entrance, the driver gets out and grabs the broom hidden in the brush to sweep the paved road. The neighbor has photos of that activity, as well.

this is where you will find truth to my statement, and then you must analyze to which direction the shadows fall. Its obvious.
And “syncing” a camera to a computer means nothing in regards to what was displayed in the video. That was an added caption to the video, not a time/ date stamp. They could have put 2AM and it would have had just as much validity.
Edits don’t quantify truth, nor does trying really hard to look honest.
come.on unfortunately your junior explorer/boy scout CSI skills have failed you. The video camera is synced to a computer which is in turn synced to an atomic clock with an allowance for Pacific Time and your shadow/light assessment is flawed. Try getting up at six AM in the summer and see for yourself or ride a bike early like I do and you will observe light and shadows notwithstanding shutter speeds and other camera artifacts

I argued that the video was not taken at 5:54AM on account of the light levels. Upon further investigation, shadow patterns are evident of a much later time in the day.
There is no evidence of anyone being rude. Only driving. Business as normal by ball accounts.
There is no evidence of the water truck being aggressive, only poor cinematic photography skills. Furthermore, holding trucks up on the road is indictable under Terry v. Ohio.

Yesterday, at least, according to a witness, ORC trucks drove in and out of the mine site at a much slower speed than has been the norm. This helped tremendously, I am told.
oh and look up the definition of a “strip mine” then reanalyze the mining plan ORC has published. There is a major difference FYI

So I guess I have a few issues with this video.
First, the video was NOT taken at 5:54 AM. Look at how light out it is. WHen was this video taken exactly? The sun wasn’t even rising that early since the early part of July, and even then it takes around an hour to get even near that light saturation. Journalistic lie #1
Second, where was the “flip off” by the driver? I could say I saw sasquatch’s reflection in the hubcaps and would have equal proof and rationale.
Third, watertrucks use the RPM of their engine to increase stream PSI. Could this just be an attempt to remedy any gravel on the road by the entrance?
And finally, the part about the photographer having to run off the road because of the oncoming truck is ludacris. There is a water truck coming straight at you on the road. You have two options. Get out of the way like they camera person did (the legal option), or illegally detain a vehicle (an intictable offense).

Actually Dan Smith is in the clear on this one. The Starks have sought to communicate with Bob Snyder – ORC Mining Director: Tim Smith – West Coast Resources Construction Manager; and Jerry Bowers – owner and operator of Bowers Trucking. Although Jerry and Tim seemed willing to work out problems in the beginning, the Starks suspect that orders from the ORC generals have been given not to communicate at all with them. The Starks have been proactive in seeking solutions but are finding it very difficult, given the status quo.
Furthermore, the short video of the water truck is of concern. The neighbor was standing in her own driveway when the passing dump truck driver flipped her off. Therefore she walked to the head of her driveway to observe that particular truck and saw the approaching ORC water truck. When the water truck driver saw the neighbor, he tromped on the gas pedal and sped the remaining distance into the mine road. This rash behavior clearly was intended to intimidate the neighbor.
So Dan Smith is just too damn busy to return a tax payers’ phone calls? But he plants his whiney ass at the IBO/Chamber of Consorts lunceon and whines like his diaper is wet. Waa Waaa Waaaaa, grow up Dan and return phone calls to the people who are subsidizing your strip mine.
