A complaint for declaratory and injuunctive relief against the US Bureau of Indian Affairs (BIA) has been filed with the US District Court in Eugene. Cascadia Wildlands, Oregon Wild and Umpqua Watersheds allege the BIA has planned and authorized the Kokwel timber sale on the Coquille Forest and that the sale violates the Coquille Restoration Act, National Environmental Policy Act, and the Administrative Procedures Act. 
If allowed to proceed the sale would threaten fourteen spotted owls already on the endangered species list.
Due to the failure to conduct surveys for the Kokwel timber sale, stands within nesting, roosting, and foraging habitat in the project area are assumed to be occupied by spotted owls. Additionally, there are four known, active spotted owl sites with home ranges that overlap the project area.
The complaint asks the “BIA to withdraw the Kokwel timber sale until such time as the agency demonstrates to this Court that it has adequately complied with the law” and to enjoin all “parties from proceeding with any ground-disturbing activity in the Kokwel timber sale area unless and until the violations of federal law set forth herein have been corrected to the satisfaction of this Court.”
