Making only one minor change, the board approved, two to one, a surface lease agreement with the ailing strip miners, ORC. Parry argued that allowing ORC to assign its lease rights put the county in a stronger position despite a legal argument presented by attorneys representing ORCA (Oregon Coast Alliance) and other citizen comments asking the clause be stricken from the contract.

I think I have a clear way to explain ORC’s situation and hopefully ( I doubt ) get some to understand why this ” battle ” has put ORC and the employees, and employees of all places effected, and Coos County income ( from tax paid by all involved ) into serious jeapordy.

Lets say you are a investor, and I have come to you about a small 1 acre piece of shore line on the Sixes river I would like to pan for gold. I have all ready tested the area, and found a certain percentage there.
I also explain I have another 10 acres that is very profitable also, and should be able to get access to that in the near future, as talks have leaned that way, and other private companies own the mineral rights.
It looks like a simple, normal process of getting the County to sign off so I can clear the dead, worthless, rotted trees there. And, give them some income also.
You as the investor see the numbers of 11 acres of Gold, you have seen the numbers to produce it all ready.You sign up, and start the process, with the thought that you have a 11 acre deal coming.( if not more ).
I start panning for gold…..The gold market crashes, and there is a stockpile right now. This is not to bad, it is a normal thing if you look at history, it is like a ” roller coaster “.With 11 acres of this, we will make a good profit when it picks back up, and be able to sell the stockpile, and future crop.
In the mean time, I am finding customers, not enough to get by yet, but showing promise.
But……As I am going along, it is looking like that 10 acres is not as promising as it looked. People are fighting it, I am having to get attorneys, I am having to spend money to educate the public on my process. I am having to hire people just to fight this battle.
Now, after over a year, you are not seeing 11 acres, you are seeing 1 being possible.With a lot of patience, you have to make a decision and tell me you can not fund me anymore. You explain the risk is to high.
I am not giving up, I know I can make this happen. I go to another source and ask for a loan to keep me going another 3 months, knowing the 10 acre deal is very close to happening. Once that 10 acre deal goes through, I will have that large stockpile of profit to show to new investors. Or, maybe I can get a partner now.
Well, my 3 months are up, still battling…..What can I do? Maybe I can squeeze another month out…
Ok, the deal was made, I now have a agreement with the County…But, I am out of money, and have only 2 to 3 weeks to find investors, and get a deal in writing…….

You also missed my reply regarding people going on to unemployment because of this battle. I see plain as day Southern Oregon is a third generation welfare place, and it seems to want to make it a 4th and 5th.
I am 47, started working full time at 17.( part time at 14 ) I missed 6 months of working in between the McCollough Bridge job, and ORC opening. I collected 4 months of unemployment in my 33 years of adult working life.

I know about IDM financial troubles. I shared susanP’s skepticism that Coos County’s lease will attract investors. That seems contrived to me, but Rob Lester’s explanation makes some sense. I don’t think anyone can really know what’s going on in corp board rooms.
I understand how markets for commodities as fickle as chromite can shift. Look how quickly the market for natural gas has shifted before our very eyes.
I know about chromite mining. I’ve read about Cr-VI and the very valid concerns about it. I think you raise real concerns. I also know about the 16 active chromite mines in India and the problems they’ve had — as well as the problems they haven’t had. I know the DEQ and the EPA have investigated this project closely and approved it. They are not shy to shut down industries that present hazards.
Yes, this lease is about access to mineral rights — mineral rights that ORC already owns. ORC has already triumphed once in court about its rights to these minerals. It is not a stretch to imagine ORC would win in court again to secure a right of way to these minerals using that case as a precedent. In fact, it would be very difficult and costly for the County to fight it. If it did and lost, we would get nothing, except more court costs.
Only if your objective is to stop the mining at all costs would this tack make sense. I’ve read your case, I understand your concerns. I’m sorry, but I think you’ve greatly overstated the risk. And no one outside of ORCA agrees with you — not the EPA, the DEQ, or even Bob Main. He voted no out of concerns about the lease transfer. That seems to be Mary’s concern too.
If you’re concerned about the poisonous effects of Cr-VI, then worries about global mineral markets, IDM’s fiscal health, lease transfers, or land access really don’t matter, do they? That’s all a diversion. Sure, if the mining operation introduces toxic levels of Cr-VI into ground water and fish habitat, then we will have made a serious mistake. However, if it that scenario is not a reasonable outcome under any circumstances, then prohibiting the mining operation on that basis would be just as serious a mistake, no?
Every choice has consequences.

The sand taken out of Seven Devils comes into our ” wet plant “….It is run through banks of ” spirals ” and a ” cleaning circuit”…With process water. ( safer water then Coos Bays drinking water ).
The Heavy minerals are seporated to be sent to the ” dry mill “.
There, the chromite, zircon, garnet, high Iron are seporated into 4 groups.
What is left from both plants is the sand without those minerals.It is dried, and trucked back out to the mine site and put into reclamation right away.
There is nothing added to anything, we just take out about 10% to 25% of a pile of sand, and take back the remaining 90% to 75% of sand we did not use.
I am confused on what you are talking about with the ” Cr-VI “…..
Actually, you are confused ( someone is ). Our plant only seperates minerals that are all ready there, we do not add anything, especially chromite. ( that is what we are trying to take out of the ” ore “.
If you were worried about Cr-VI, well, it has been there for millions of years now.
Maybe after reading some of this, you should have been helping ORC, considering we are taking it out for you.
The best way I explain the plant to people, is consider it ” panning for gold on steroids “……That is basically all we are doing, other then no gold involved. ( to bad though )
P.S……If anyone is aware of ” flocculant ” we use that also, not very much of it, and so everyone is aware, it is food grade, and is in tooth paste, and oat meal.
Also, we have a water treatment plant that is monitored like a Hawk. I help with that, it is to process rain water back into the bay. Our ” process water ” is actually just as safe to drink, and it is re-circulated through the plant.

Here is my very limited layman’s understanding of the Cr-VI hazard:
Mining for chromite disturbs naturally occurring Cr-III which when exposed to oxygen becomes Cr-VI, a toxic substance. However, Cr-VI is also a naturally occurring substance which is very unstable and therefore breaks down quickly through natural processes.
Since the ORC mining operation encompasses no more than 10 acres at any one time, the amount of Cr-VI that is created and not summarily rendered inert is smaller than miniscule. The findings of several studies confirm this. They find Cr-VI present, but in very, very small amounts. Therefore both the DEQ and the EPA have found ORC’s mining operations to be perfectly safe to groundwater, aquifers, and fish habitats.
The BWCA has failed to prove the case that ORC’s mines will render the watershed toxic because at the end of the day there was no case to prove. The rest of the argument — foreign corps, lease transfers, IDM’s health — is nothing but noise.
Look, if this operation were unsafe I’d be the first one to oppose it. But when you view ALL of the evidence, that’s just not the case. There is just no other valid reason to object to it.

They havn’t paid their loans & were given until the end of the year to get current. ORC hasn’t paid any royalties to its investors. The Board of Directors for IDM are leaving their posts. On the 26th IDM diluted its stock by 10% . ORC cannot sell its product.There was no lease ever signed until the 26th of this month. The court case you refer to was about mineral rights not access which is what the lease is about. What you missed Mark was coming to the BOC meetings. What you missed was researching IDM & ORC instead of believing what you were told. You would have a different outlook if you really looked at all the factors involved. Oh and by the way IDM’s own audit company doubts ORC will survive as a going concern.

I’m still skeptical of ORC’s prospects, but I believe it’s in Coos County’s best interests for it to do well. (Hard to argue otherwise now, even if one opposes the project.) Being bullish on the global economy in the near future, I think it’s very possible for things to work out. It will be interesting to watch.
I hope you continue to post. The best blogs welcome all viewpoints. Otherwise confirmation bias sets in and you end up with things like the Republicans sitting around stunned that they lost the presidency.

We had 7 years left on the current mine.( reserves )With the economy, and little demand ( about a years supply out there at current useage ) the current investors had enough.,,,,Now, surprise, the reason why.
Look at it like a savings account.
This savings account had a end, the end was the seven devils mine, the one with 7 years left.To keep running and only have those reserves is not profitable at all.The investors red the papers, and saw little hope when a community is fighting any progress.They were not willing to bet on that wager.
If we had 15 to 20 years 6 months ago, they would have more likely stayed with us knowing a profit is there.
Now we finally have the lease signed ( the lease presented to ORC by the Council 8 weeks ago, and accepted and signed by Wayne 8 weeks ago).

I think it may be to late to continue running, I am praying it is not.2 to 3 weeks to get new investors or a buyer is not much time, it takes 30 days to get into a house with agreeing people.
Does ORC have a chance? For sure. 2 to 3 investors are ” very serious ” about it.They were waiting for the outcome on the hearing I believe.

Bottom line, more reserves equals more total profit, and making more sense to produce and store it until economy is back.

If ORC has to shut down, and put 100 ( give or take ) employees out of work ( make that 400 people without income, count in the spouses and children) it will not be ORC’s fault. It will be the people who fought this, and did not bother to listen to the warnings.

Ok, this has been answered numerous times.
ORC had about 7 years of mine life left at seven devils.Yes, ORC is struggling, because the economy is struggling.
ORC’s original investors were ” done ” being worried only 7 years of reserves would never be a profit, not matter how long the finished product sits.Trying to get investors in on a 7 year reserve is near impossible, bit a 15 to 20 year reserve, it would be a lot easier.
Now we have that, and ” us ” employees ( the production staff, like me ) have a little more hope that we will have jobs for another 10 years.
I hope it is not to late, from the needless bickering, and postponing of this lease.
If this had been done sooner, there would be no worries, and 61 employees ( all with children, wives, grand children to raise and care for, so lets say 200 people ) would not be in jeopordy of not being able to support their ( our ) families.
I wish people would look at that part, and quit trying to fight ” businesses ” just for something to do.This may have been to late, and could put families on the street, raise unemployment in Coos County, and lose revenue to small businesses in Coos County.
I did not include WCC employees, Bowers, and the businesses ORC uses.

What was the ORCA argument? Why would ORC change the agreement? Hasn’t it already held up in court? It may not be the best deal the county could have gotten at one time, but that is water under the bridge at this point.
That agreement, as poorly written as it is, or written any other way, should not cause investors to rush to IDM/ORC. There is little doubt that ORC is near the end of its journey. At least Main can someday day I told you so. The new controversy to be discussed here soon (hopefully) is looking worse.
I agree with you about the investors. I don’t see why our little ol’ strip mine is so important to an international corp like IDM. Especially since the price is depressed.

I was working on the McCullough bridge I believe at that time, and new nothing about it. Strange considering I know a few ODOT employees.
At that time, if I had heard about it, I would have looked more into it, and found the true reason they were laid off.
It is ludicrous to suggest those County road workers were laid off because of ORC.

As a volunteer unpaid blogger if I duplicated work I did three years ago every time someone asked me I would be doing myself a disservice. Why don’t you help Lester, Mark, go through my archives, watch the videos and listen to the audio recordings or conduct your own search.
