Judge Richard Barron denied the motion for a retrial filed by Nick McGuffin’s lawyers on all counts. Attorney Shaun McCrea gave a lengthy argument on behalf of her client and was at times combative with the judge. McGuffin attended via video conferencing and took notes during the hearing. The prosecution response was to stand upon their brief in rebuttal to the motion. Barron addressed all issues raised by the defense and citing various case law in supportive of his denial.
McGuffin was convicted of 1st degree manslaughter in the 2000 death of fifteen year old Leah Freeman.

I full heartedly believe that nick was wrongfully convicted. I have had the pleasure of knowing him. If any of you could have known him you would have known a sweet, caring, kind funny guy. And he loved leah so much. Besides that how can they convict someone with no evidence. They say that they found a grey paint chip that matched the paint from his car… has it ever occured to anyone that she was his girlfriend and went everywhere with him in that car. He did drop her off at her friends house so that could possibly explain the paint chip. Nick hang in there babe. I pray to god that the real killer will will face his punishment soon.
I suppose but an appeal can take years and is very expensive and rather than overturn a verdict may just require a retrial. He will be out by the time it all winds through the court and the lawyers will be much richer.
Again, I have to wonder if the friends or family who helped him cover this up don’t now wish they had urged Nick to do the right thing back when Leah first died. Nick might have served a couple of years and now be well on with his life.
So now what? An appeal?
